Application of the Charter of Fundamental Rights to homelessness support

Following the judgment in SSWP v AT, the IMA’s position is that the Charter of Fundamental Rights also applies in the context of homelessness support for EU nationals with pre-settled status who are otherwise excluded due to their circumstances.

The IMA has engaged with the Ministry for Housing Communities and Local Government (MHCLGand the Devolved Governments, and continues to liaise with them to ensure their guidance to local authorities properly reflect the application of Charter rights for this cohort and is updated in light of the changes implemented by the Border Security, Asylum and Immigration Act 2025.
