SE vs SSWP Guidance for Decision Makers

Following the Judgment of SE vs SSWP [2024] the IMA is working with the Department for Work and Pensions to update its Guidance for decision-makers to ensure clarity and compatibility with the judgment.  

Dual UK EU citizens and EU Nationals within scope of the Agreements can challenge DWP decisions that deny Carers Allowance (and potentially other sickness benefits) based solely because of “competent state” arguments.
