Victims of domestic abuse: Migrant Victims of Domestic Abuse Concession (“MVDAC”) and Appendix Victim of Domestic Abuse to the Immigration Rules (“VDA”) and WA compatibility

The IMA is currently considering the impact that the domestic immigration routes, Migrant Victims of Domestic Abuse (MVDAC) and Appendix Victim of Domestic Abuse to the Immigration Rules (Appendix VDA), has on a citizen with Withdrawal Agreement rights (WA), who has been awarded EU Settlement Scheme (EUSS) Pre Settled Status (PSS). 

The Home Office has implemented changes which now allow those citizens who do apply for one of these alternative routes to retain their PSS status. This status will be able to be confirmed through additional checks however the citizens digital status will only reflect the most recent grant of leave. This change, while welcomed, has led to further questions concerning its implementation and compatibility with the Withdrawal Agreements. We continue to discuss these changes with the Home Office.
