Date Legislation considered: 29 May 2025

Date Legislation in force: 31 March 2025

Relevant Withdrawal Agreement/EEA EFTA Separation Agreement Right(s): Residence, Social security co-ordination

What does the legislation do?

These Regulations introduce changes relevant to the Scottish Adult Disability Allowance (“the Allowance”), which replaces the predecessor Disability Loving Allowance for adults in Scotland. Some of those amendments are discussed in the Policy Note.

The provisions relevant to the IMA’s remit are confined to those concerned with residence and presence conditions.

The provision made in that regard covers those within scope of the social security coordination provisions of the Agreements who are entitled to the Allowance.
